Stop the abuse of Eminent Domain

There is a Virginia  Constitutional Amendment on the ballot on Nov. 6th that will affect the property rights of citizens all over the Commonwealth. A vote of "YES" will protect citizens from land grabs and "close the loopholes in Virginia law that are the result of the Kelo decision". 

Citizens want a resolution from the Board of Supervisors. Will they go on record supporting the constitutional rights of citizens and the end to governmental land grab and abuse?

We have placed two on line petitions, one for York County and one for James City County which will be presented to the Board. Please support our efforts.





We the under signed citizens request the Board of Supervisors adopt a resolution supporting the  amendment to the Constitution of the Commonwealth of Virginia, which will appear on the ballet  on Nov. 6th following suite with numerous counties across the state in support of the eminent domain amendment.

Resolution in Support of the Commonwealth of Virginia Constitutional Amendment on Eminent Domain;
Whereas, this country was founded on the principal of private property rights and this has become an important aspect of the American dream; and
Whereas, the Supreme Court of the United States has indicated that the use of eminent domain laws are a States' rights issue; and
Whereas, the government taking of privately owned property should be limited to the need for public use projects only; and
Whereas, citizens should be adequately compensated when their property is taken for government use including loss of use and/or income; and
Whereas, both the House of Delegates and the Senate of the Commonwealth of Virginia has twice passed an amendment to the Constitution of Virginia regarding eminent domain; and
Whereas, the constitutional amendment will be on the November 6, 2012 ballot for approval by a majority of voters in Virginia
Now, Therefore Be It Resolved That, the James City County Board of Supervisors does hereby support this constitutional amendment restricting the use of eminent domain in the Commonwealth and encourages its citizens to vote yes on the ballot in November.
